Service Agreement/Client Terms

By purchasing services from Clay Flood Concepts, the client agrees to the following terms:

  1. SERVICE DESCRIPTION

Clay Flood Concepts provides standardized conceptual flood visualization products based on predefined modeling assumptions and visualization methodologies.

Deliverables may include:

  • conceptual flood depth maps

  • conceptual velocity maps

  • conceptual flood visualizations

  • KMZ overlays

  • animations

  • topographic visualizations

  • or related graphical products.

  1. STANDARDIZED PRODUCT FORMAT

Services are provided using Clay Flood Concepts’ standardized approach and are not customized engineering studies unless explicitly stated otherwise in writing.

Clients acknowledge that examples shown on the website represent the general style and format of delivered products.

  1. NOT FOR REGULATORY OR ENGINEERING USE

Deliverables are conceptual and informational only.

Deliverables shall not be used for:

  • engineering design

  • permitting

  • FEMA determinations

  • floodplain certification

  • insurance rating

  • construction decisions

  • emergency evacuation timing

  • regulatory compliance

  • or life safety decisions.

  1. MODELING UNCERTAINTY

Flood behavior is inherently uncertain and may differ substantially from modeled scenarios.

Actual storm behavior, rainfall intensity, watershed conditions, debris blockage, infrastructure performance, terrain conditions, and other factors may significantly alter real-world flooding conditions.

  1. CLIENT RESPONSIBILITY

The client is responsible for determining whether the services offered are appropriate for their intended use.

The client agrees not to represent deliverables as certified engineering products or official flood studies.

  1. PAYMENT TERMS

Payment terms shall be as specified at checkout or within the service invoice.

Full payment is required before final deliverables, downloadable files, maps, animations, KMZ files, or other project materials will be released to the client.

Clay Flood Concepts reserves the right to withhold delivery of completed products until payment has been received in full.

Failure to complete payment may result in project cancellation at the discretion of Clay Flood Concepts.

  1. REVISIONS

Unless specifically stated otherwise, services do not include custom revisions, alternate storm events, or modified modeling assumptions.

Optional add-ons may be offered separately at Clay Flood Concepts’ discretion.

  1. DELIVERY

Estimated delivery timelines are approximate and may vary depending on workload, data availability, technical limitations, weather events, or other operational factors.

  1. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Clay Flood Concepts, LLC shall not be liable for damages arising from:

  • reliance upon deliverables

  • flood losses

  • property damage

  • business interruption

  • personal injury

  • or decisions made using provided materials.

  1. ACCEPTANCE OF TERMS

Purchase of services constitutes acceptance of these terms and conditions.

  1. GOVERNING LAW

These terms shall be governed by the laws of the State of Texas.
